Looks like a primitive legal mechanism to me - something like the Inquisition? Can one refuse to incriminate oneself?
In South African law there is something similar in the case of insolvency proceedings - which has even received the approval of the ConCourt: One cannot refuse to testify, but apparently incriminating evidence cannot be used against you!! It opens the way to build a case against you on a basis which does not rely on your testimony - and they call that justice?!
